It makes me wonder how half the songs out there are'nt being sued right now. I guess Kid rock had to get permission from Skynard to do "all summer long". If not it makes me wonder how that kind of stuff works. I would never steal someone elses song and try to say it was mine, but sometimes a phrase or jingle might come from your subconcious and get your ass in trouble. I think that judge went a little far there in the amount of the award to someone who didn't even write the tune. Just my 2 cents.

Yes I agree, you would think after 70 years it would be public domain. But since the publisher bought the rights from the songwriter they have the ability to sue anyone who uses the tune without permission. The original writer died without receiving any royalties, which would have been a tidy sum back in the 80's.

Not trying to hijack this thread but right now we are trying to put a name on the original project I'm working on. In 98 I played with some guys around here and we had a name we liked and became pretty well known for in this area. Since 2 of us were original members, we thought we might use the name for this band. but looking thru my space found some kids out of Mass. had already done something with the name in 07 though hasn't been updated since 08. I doubt we would try to use this name now but I'm worried with so many bands out ther how does a band find a suitable name for itself without stepping on another bands shoes or vice versa ? I've heard Craig mention this recently and would love to hear from anyone else regarding this issue. Also when I look up songs in I tunes or some of the other popular sites I notice if you look up a song ther might be 10 songs with the same title . Its getting tricky if you as me.

Especially considering that the label made a majority of that profit. I didn't read the link, but am familiar with the story. Did the judge find only against teh band?

There's an old thread devoted to band names - I'd check them out. But yeah, the dictionary has pretty much been exhausted, so no you have fuse partial words together. Or name your band your name spelled backwards. There's a novel idea LOL.

Eh, not that novel. A band here in Detroit did just that; the guy's last name is Miller so you guessed it: the band's name is "Rellim". These guys will play for very little and have low-balled other bands out of gigs.

Might be kin to me LOL . My mom was a Miller.
