It won't make it anywhere near any Supreme Court.
From what was presented, the father just reacted to the situation, and sh*t happens.
You can't call the police and wait for them to get there to help in situations like that, you have to do something.

As a father of three daughters I am surely glad it was not me in that Texas father's shoes. I am not sure I would have had the wisdom or courage to dial 911. I raised my kids in a fairly small town by Cali standards and when it came to my kids, everybody knew the drill: I owned a 12 gauge and a shovel and I was pretty handy with both. An elevated level of deterrence encouraged everyone to behave themselves so the tools were never pressed into service.

However you don't have the right to stop them and come back an hour later and kill them. If someone is breaking into your car or house at night you have the right to use deadly force to stop them. The Constitution guarantees us all the right to be secure in our life and property. The goal of the law is to protect innocent people, not perps. If someone is raping my daughter, I'm not waiting for the cops to get there and if the guy dies just because I hacked him several hundred times with a machete, well, that's just too bad.

If you do use deadly force in Texas you will still have to face a grand Jury. Only a phuking liberal would allow the case of this father that defended his FOUR YEAR OLD DAUGHTER to be sued by the family of this perp. In Detroit they might allow it but NOT HERE IN TEXAS! The big problem is how he killed him - when you beat someone to death there's an intent to kill; he could have beat him severely and left him to rot in prison or be executed, since this is Texas. He might actually have been better off to shoot the perp. I predict this is not the end of this case.

I had a chance to move to Texas years ago and work for Texas Instruments. Had I known then what I know today I would be living there.
