Hello everyone I have a question for you music experts out there

Hi all. Nice to meet you, and allow me to introduce myself.

I'm a musician and I am about to start up a record label and go totally independent. I don't think I am going to sign up with a record label and I plan to do everything myself.

I'm just starting out, and I can't afford to hire a lawyer but I need to create a contract that I can use to give my lead guitarist a guarantee that he will get a royalty check from me.

Does anyone know of a website that I could go to that would give me a similar type of contract that I can copy and edit myself and just change it around?

Best place to start is the bookstore or library. There are plenty of do it yourself books on starting a label. Can't recommend anyone in particular but I've seen some.

Even if you create a contract on your own, you or the guitarist should have a lawyer go over it.

If you write up contracts, make sure you stick to these basics:

Contract: the elements of a contract

The first step in a contract question is always to make sure that a contract actually exists. There are certain elements that must be present for a legally binding contract to be in place.

An offer: an expression of willingness to contract on a specific set of terms, made by the offeror with the intention that, if the offer is accepted, he or she will be bound by a contract.
Acceptance: an expression of absolute and unconditional agreement to all the terms set out in the offer. It can be oral or in writing. The acceptance must exactly mirror the original offer made.
If negotiating, a counter-offer is not the same as an acceptance. A counter-offer extinguishes the original offer: you can’t make a counter-offer and then decide to accept the original offer! But…A request for information is not a counter-offer. If you ask the offeror for information or clarification about the offer, that doesn’t extinguish the offer; you’re still free to accept it if you want.
Consideration The contract need to offer "legal" and sufficient promise of somthing in exchange for something. Both sides must be afforded this.

My suggestion would be to lay out a pricing schema (based on industry standards) and work form there. At all times, do not screw the other guy...But most important, don't screw yourself out of fair compensation.

If you know someone who has recorded and has a contract from that recording session, then you can copy it and then modify the parts to suit your circumstances. I've done that with gig contracts and it worked out just fine.

The previous post that shows the legal aspects necessary to be an actual contract was dead on. Pay close attention to that.

Royalty checks typically come from places like BMI or ASCAP and are paid to the legal owners of the publishing rights and to the songwriters.
The publishing company then distributes to others based on any contracts.
There's a lot more to it than just 'forming a record label'. You've got to set up corporations or LLCs.

If you're going to self-record and sell CDs online and at gigs, then a simple contract will work fine - that's not 'royalties'.
