Ever since the record companies lost revenue from people dl'ing the music for free from the internet, they feel like WE the public are stealing from them.

Now it's a free for all, grab as much money as they can in any way they can.



Politicians are the biggest scumbags, followed by lawyers and then the record companies.

If I ever won the lottery I'd buy a bar and call it All Original Bar and only allow musicians who play their own music. Of course I'd probably lose my shirt on it but having won the lottery I wouldn't care. I wonder if BMI could demand their fee from me at that point.

If a venue is featuring cover bands and not paying the PRO's, they are stealing from the copyright owner.

Not positive but I think if the bands played any selections from any recordings that were published you would still have to pay BMI or ASCAP.

Your hostility aside, I would submit that you don't really understand the functions of a PRO. I have been a member of BMI for a long time. They protect the rights of copyright owners, not 'greedy ass record companies and other parasites'. If the record company owns the publishing rights to a composition, they are entitled to the royalties.


As for me personally paying BMI or ASCAP for performing rights, I would refer you to this, from ASCAP's website:



"12. Aren't musicians, entertainers and DJ's responsible for obtaining permission for music they perform?

Some people mistakenly assume that musicians and entertainers must obtain licenses to perform copyrighted music or that businesses where music is performed can shift their responsibility to musicians or entertainers. The law says all who participate in, or are responsible for, performances of music are legally responsible. Since it is the business owner who obtains the ultimate benefit from the performance, it is the business owner who obtains the license. Music license fees are one of the many costs of doing business."

I believe if you want to cover a song (whether you play it live or record it) you can obtain a blanket performance license for $250. You would also owe royalties to the publishers if you sold any copies of the performance. It doesn't matter if you do the song exactly as it was originally written and recorded or if you rearranged it, if it's substantially like the original you would owe.

I think if the artist (original music) is a BMI or ASCAP member the venue still has to pay. If the artist is not a member then you don't.

Yes that makes sense, although most if not all publishers would be members of one or the other or both.

The bottom line is that these rules are there to protect the artist and publishers, not to make life hard for them. People who think "the artists makes big bucks and the record companies make big bucks, why should I pay them" are the problem. Stealing is stealing.
