it was very fascinating reading about the problems with running forums, how hard it is to manage what people say to keep from getting sued.. some doctor won $675,000.00 after he read some post on a yahoo board that was slandering him.. just the intricacies of the laws that are in place for this is extremely fascinating.. hyperbole and such..

I'm Sorry You and Lynard aren't getting on well... The thing to keep in mind, is that on this site, its nothing but an exchange of electrons, formed up as symbols. When these symbols align with the stuff 'we' bring into the forum, as we read them, then that's when we tend to get upset.

Just on sheer principle and my inner sense of optimism, I believe that you and Lynard are basically good guys through and through... Even if you have issues (and we all do) , you're still both decent folks at heart...

So My advice change the symbols so as not to press the buttons that align with what ails each other... In other words, switch to kinder words...

(This of course, does not apply to lawyers...So please feel free to tell your lawyer to piss off )

PaperDog, you might want to go look at the posts and see who always starts it... you will see I never instigate anything, but I am guilty replying negatively to him... here's the link about the doctor who won $675,000.00 in a libel case on the internet forums.. (at bottom of post) this happened, so it is good practice for all of us to keep it at a hyperbole level or statements that are "an opinion" rather than stating untrue and damaging statements..although after reading for hours on this subject last night I find "opinions" might be libel.. it's all in the way you say it and imply it.. like Lynard thinking he's so smart as to use "dame" I pointed out they(the court) would know he means "Dane" .. also read libel per se can be brought up against someone simply calling a person a communist if it is not true, and pretty easy to prove if you are a communist or not... if people only were aware ..

Again, the pivotal element is "damage".

More importantly, damage must show itself as "harm" to one's reputation.

Publishing a statement about specific prostitute and calling her a "whore" is not a libelous statement, because 1) Her reputation as a 'hooker" precedes her and thus cannot be harmed by the statement. 2) the claim is 'True", albeit tasteless description.

So Dane, my question would be... regardless of what Dylan has posted, What exactly is your reputation? and Where's the 'harm' to your reputation?
Does Dylan';s statements put you at risk of losing a material amount of opportunity , resources, etc? ..Does it circumvent your pursuit of happiness?
