Doing something stupid on a daily basis, and doing something stupid that gets someone killed are two completely different matters.

Negligent homicide is a crime.

Simple stuff really.

How do you know she did it everyday, George? Nowhere in the article did it say this woman did this every day. Something went down and she admitted to getting home later than usual.

In mine, the total responsibility lies with the drunk who failed to control his vehicle, due to his choice to drive impaired. The victim could just as easily been any unwatched child chasing a ball into the street, which is something that we all must watch out for at all times...or any pedestrian walking too close to the street & taking a fall...or any number of other scenarios.

Keep in mind that he hit THREE PPL, not just a disobedient kid running from his mother. Do you not think that perhaps he should have SEEN them all, & would have reacted differently if he were unimpaired?

I was actually speaking of people in general Chaeya and myself in particular.

I had thought you knew my personality well enough by now that I'd not have to make disclaimers every time I post.

I said she was responsible ... as was the driver, and the child.

I see the world a little different than most.

We are responsible for our actions.

Where responsibility is held in esteem, there is no need of fault.

Here's one case for you. A kid kept climbing out of his playpen. So the sitter and the mother decided to put a metal mattress spring on top of it to keep him in there. They thought he wouldn't be able to lift it because it was too heavy. Somehow the kid managed to get in between it, but he let go and it fell on his neck and he was choked to death. The coroner confirmed the method of death and the cops deemed it a horrible accident. Stupid, but a horrible accident. They figured the mother was suffering enough dealing with the death of her child.

Should this woman have had a trial? Should she have been put in jail for this?

What's the difference between this woman's stupid mistake and the other's?

Should these women both be put in prison next to a woman who willfully and knowingly starved her child to death?

So get your record unstuck off the responsibility issue and answer my question, please.

CHaeya, you know good and well that the philosophy behind this question has NO relevance whatsoever in a trial. If the lawyers can make more money convicting rather than deciphering the degree of negligence, then that grieving mother is goin down...Simple as that.

True that. Not to change the subject, okay, I'm changing it, a lady on another forum has fallen on hard times and went to a lawyer about bankruptcy and he talked her into filing Chapter 7. This is a no-no if you have a lot of assets. This lady has written quite a few books over the years and collects some nice mailbox money via book sales. Well because of the Chapter 7, the trustee has gone after her book royalties to the point where now they barely have enough to live on and now he's calling for a force auction of all her book copyrights. Can you imagine how devastating this is for her? So she's had to go pay another lawyer to sort out the mess, most of the other lawyers don't want to touch it because they can't fight the trustee. It's really sad.

Agreed...Very very sad and it irks me to no end. I really feel for that woman...

You know , if I ever strike it rich, I might just invest some money to hire a team of lawyers to destroy another team of lawyers. With any luck, I can syndicate it and make a reality tv show out of it... Seriously, The world need to get rid of @ 80 % of the attorneys.. They are like weeds.
