Court ruling could mean millions in online royalties for Eminem, other artists

Eminem probably thought he'd be waking up this morning to focus entirely on his concert tonight at Comerica Park.


Instead he got a bit of unexpected news from a federal appeals court in California: some major money could be headed his way.

The decision, which one Eminem attorney calls an “earthquake” for the music industry, could transform the online song business and boost the fortunes of untold numbers of artists.


Reversing a lower-court jury decision from last year, the court ruled that Eminem and his production company are entitled to nearly triple the royalties they've been receiving for track sales and ringtones on online services such as iTunes.


For Eminem, who has sold more than 6 million downloads this year alone, that could mean tens of millions of dollars in new income.


Universal Music Group, the defendant in the case, said this afternoon it will petition for a rehearing.


The suit was filed by Ferndale's FBT Productions, which administered Eminem's record deal with Universal.


Today's ruling could have fallout in the evolving world of digital music, experts said, pushing other artists to negotiate with their labels for higher online royalty rates. It could even pave the way for some holdouts, including Detroit’s Bob Seger, to finally offer their songs online.


The decision

The U.S. 9th Circuit Court of Appeals unanimously reversed a 2009 federal jury decision in a lawsuit filed by Ferndale’s FBT Productions, Eminem’s former production company, against his label, Aftermath Records. The jury had ruled in favor of Aftermath and its parent company, Universal Music Group.


Eminem was not a direct party in the suit, but he benefits through FBT, which shares his contract with Universal.


“This potentially readjusts the economics between the artist and the record company, and that’s been long overdue,” said FBT’s Joel Martin. “It puts Eminem in a position he should have been in to begin with, which is to receive a larger portion of the download royalties.”

He has been voted the Best Rapper Alive in a Vibe Magazine poll. He's probably won more grammys than any other rapper. I don't think any reasonable person, would deny that he is one the Top-10 rappers of "all time", and I would say that he is at least among the Top-5. I also don't think it is unreasonable for someone to believe, he is the greatest rapper of all time. It really depends on what that person's criteria is.

He's also one of the most influential artists of all time.

He's influential in a number of ways. His volume of sales alone, makes him a force in the music industry. He is highly respected as a lyricist by EVERYONE in rap. He is considered to be one of the Top-10 rappers of all time, by ANY poll, or ANY review found anywhere. It's like saying that someone who was in the Top-10 golfers of all time was not also influential, or that someone who was in the Top-10 guitarists of all time was not influential. Being in the "Top-10 of ALL TIME" of ANYTHING, makes you influential in that field.

The recognition that comes with his being white, is merely because he broke barriers in a traditionally BLACK dominated genre. Much the same, as Tiger Woods is lauded, in addition to his great skills, for having broken barriers in a traditionally WHITE dominated arena.

But Eminem's standing, like Tiger's, is ultimately about being among the most skilled, OF ALL TIME, in their respective fields. And NOT about their color. That's really just a footnote, when you are talking about being the "Greatest of all time" at something.

It's not BS. I mentioned SEVERAL ways in which he is influential. If you want to focus only on him from an artistic standpoint, then fine, but he is considerably influential there as well. I have watched NUMEROUS legends of rap, compliment Eminem's lyricism, vocal skills and energy, and as a performer. Like Tiger Woods caused everyone else in golf to up their games, IMO, so too did Eminem force other rappers to up their games.

Eminem is a phenomenal rapper. He has his own style and he's bad! Even black people have accepted him. You hear that guy rap and there ain't sh*t you can say about him, really. And I don't even care for rap that much. I get sick of it.

But this will make Craig happy, just like Jimi Hendrix a black guy is the greatest rock guitarist of all time.

It's all good.

It always makes me happy when people break barriers, and pave new ground, whether it is women, people of color, or whatever. I'm "VERY" proud, for example, that the country elected a black president. They just elected the wrong one! LOL - And I am also looking forward to seeing a female president in my lifetime.

It may seem paradoxical, but once the walls are broken down for ALL, by various races and sexes achieving the SAME STATION, then... it gets to be about TRUE EQUALITY, because it ceases to be a big deal any longer, that any certain race or sex, achieved something lofty. And this in turn, convinces millions of other women, or minorities, that this is also a goal, they may accomplish themselves, one of these days!

This may sound stupid but just the fact that he devides people like on this forum is reason enough for me to respect him.

I dont like his music and wouldnt buy it but I have to respect him as an artist.

And any ruling that helps musicians retain more money is cool by me.
