I don't think there is a federal trademark thingie, it's state-by-state.

I remember reading about this on a thread in some other forum. The basic premise was that a band name is not really a 'trademarkable business' that can be registered federally. You could certainly do a search on TESS, the trademark search engine to see if that other band had registered it federally.
So you can either release the CD under the band name you have used (that someone else is now using, too), or change it.
The advantage of changing it is that any online listings (iTunes, for example) won't show yours and their albums together, a problem I've had with another solo artist with my name.
