thank you sans. i've learned that in the future I should explicitly say: "if someone offers more in the meantime -all bets are off".

If you feel like you did right, thats all that matters.

I was at a loss for why Sans wrote this, so I re-read the original post. I realized that I misread it, and somehow interpreted that Mike was WAITING to sell it to the guy THE NEXT DAY to give the listing more time (one day more).

Oops.

Now I realize, that he "wanted" to give the listing more time, but that by selling it to the $40 dollar guy, he was NOT giving the listing more time.

So, in light of that...

Yes Mike, you made a moral mistake in my judgement, because it sounds like you absolutely committed to the price, without any wiggle room.

In the future, to avoid this circumstance, simply tell the potential purchaser:

"I really don't want to sell it for that price, so fair warning, if anyone else gives me the full price before you can pick it up, then it's theirs. If not, then you can have it at that price. First come first serve."

There is always the possibility that the $40 dollar dude would change his mind as well, who knows? But that is beside the point. When YOU give your word to something, you really should do your best to honor it.

As I would have told my own kids...

"You just sold your character for $10 bucks."

I guess it's a question of 'did I give my word' and the fact that I felt guilty at all may suggest I did, even tho I never gave it explicitly.

I've def learned a lesson because I don't like to make ppul feel bad... and I would have felt bad myself if this had happened to me.

Given that dynamic I realize the fair thing to do would have been to call dude up and say "hey, do you now want to pay $50 in light of this other guy?". At least he would have had the chance to pay the extra ten bux and get it... I could have lived with myself if I'd have done that.

Always complete the deal you made to the first guy. A deal is a deal regardless of whether it's written or not.

it seems the mix is split with the majority echoing your sentiment... and I will abide by it (the dude abides) as best I can in the future.

It's always best to follow your conscience on matters such as this. If you feel unconfortable or have to question whether it's o.k. to change course after making what you feel to be a committment, then stay on your original course - stick with what you know you'll feel comfortable with after everything is settled. You'll be able to sleep at night with a clean conscience, not spend the evening wondering if you wronged someone.

Its good to see that somone cares and has a conscience when dealing with others in business even on a small scale. Its too bad that theres not a lot more out here who care as much about how a simple transaction would effect another person or his own reputation. I don't think you done anything wrong other than maybe offering it to guy A for full price first as you had asked from the beginning. Again my hat is off to you .

this scenario happened to me recently-

I looked at a house rental, it listed for 1050/mo

It was a really great deal considering all utilities, including Sat TV and wireless internet were part of the package, everything except electric was covered (HW Heat too !)

He said he was looking for long term renters and really didn't want someone who planned to move out after a year or two...

I asked the guy if he would go $950 if I signed a 5-year lease, guaranteeing no turnover like he might have with a year-to-year.

He agreed that it was extremely fair and liked the offer. My wife was down with the flu that day and unable to come, but I wanted to make sure she liked the place also, so I asked him if we could come by that Saturday (two days later), so I could show it to her, but said I was 99% sure she would love it and to go ahead and draw up a lease. He said he would be fine with that.

The very next day, he sent me an email saying someone offered him his asking price and he signed a year-to-year lease with them.

Yeah, I was pissed, but whadda gonna do?

kramer: I dunno, this seems more cut and dry to me cause it's clear the transaction wasn't "written in stone". There was a def feel that your wife could poo poo the deal so... there was no deal yet. I sympathize with you... but "it don't mean nothin' till you sign it on the dotted line" and in this market I kinda can't blame the guy for securing his interest. All this does not mean you don't have the right to feel bad about it... and I'm certain I wouldn't be happy about it... but like you said... what r u gonna do?
