Records regarding an indictment of former Secretary of State Hillary Clinton may soon become public against the wishes of the Obama administration if a government watchdog group has its way.
Judicial Watch announced Tuesday that it had filed a lawsuit in U.S. District Court against the National Archives and Records Administration under the Freedom of Information Act. The organization has been seeking copies of indictments against Clinton drafted in the late 90s over her involvement in the Whitewater scandal.
The issue dates back to March 9, when Judicial Watch first requested from the National Archives all indictments from Hickman Ewing Jr.’s files that applied to Clinton. Ewing served as deputy independent counsel from September 1994 to January 2001, the organization reported.
Ten days later, the National Archives responded that it had located 38 pages of documents in a folder labeled Draft Indictment and an additional 200 or so pages in another folder labeled Hilary Rodham Clinton/Webster L. Hubbell Draft Indictment.
However, the National Archives denied the request for access to those documents, citing privacy concerns.
After an administrative appeal of that decision was delayed for five months the National Archives finally notified Judicial Watch that it had received the appeal, but added no additional information. In response, Judicial Watch filed its lawsuit.
During the Whitewater investigation, Clinton was alleged to have drafted a document concealing a fraudulent $300,000 cross-loan from federal investigators. Her grand jury testimony and alleged further concealment of billing records regarding the drafting of this document were reportedly investigated for possible obstruction of justice or perjury offenses.
Judicial Watch has confirmed the existence of draft indictments of Hillary Clinton for her lies and obstruction in the Whitewater bank fraud investigation, stated Judicial Watch president Tom Fitton. The Obama administration is refusing to release these records out of concern for Hillary Clinton’s privacy.
Hillary Clinton’s privacy cannot be allowed to trump the public’s interest in knowing more about whether she obstructed justice and lied to a federal grand jury, he concluded.
Legally, of course, Clinton remains innocent of these charges unless and until they are proven in a court of law. That doesn’t mean, however, that the American people should not be made aware of these accusations against a woman who wants to be their next president.
But that’s exactly what Clinton will prevent, if she has her way.
