Marilyn Mosby has quickly gained a reputation for using prosecutorial tactics usually not seen outside of Kafka’s “The Trial.”
From calling Baltimore cops “thugs” via Twitter (and then claiming her account was “hacked,” much in the same way Anthony Weiner’s was) to denying that she was the one who initiated the drug sweep that nabbed Freddie Gray in the first place, she’s more or less broken about every rule in the legal handbook.
Now, Baltimore City State’s Attorney Mosby wants to prevent the six police officers charged in Gray’s death from publicly sharing Gray’s autopsy results.
In a motion filed in court on Tuesday, Mosby claimed that the defendants “have demonstrated a likelihood of publicizing discovery materials in a manner that may jeopardize the ability to conduct a fair and impartial trial.”
“The Court must not allow the discovery in this case to further fuel a defense public-relations firestorm,” the brief read. “The evidence must be made public, but its release to the public must be made in a court of law, not in defense efforts to court public favor.” (H/T WZ)
Reading through the lines here, one thing becomes clear: Marilyn Mosby is essentially admitting the indisputable facts of the case would prejudice the public against the prosecution.
If the state is admitting the facts under which the state is prosecuting the defendants would lead the public to support the defendants, one wonders why there’s a case to begin with.
The autopsy results could prove two things that had been reported previously.
Firstly, it could prove the allegations by a prisoner being transported with him that Gray had been trying to intentionally injure himself in the back of the police van. If that were true, it would eliminate any cause for the case in the first place.
The other thing it could confirm would be the allegations of an anonymous Baltimore police officer, who claimed on Fox News that Gray had been involved in a drug transaction and may have swallowed a large dose of heroin to avoid being arrested for trafficking.
If the toxicology results were to show Gray had a significant amount of drugs in his system, not only might it possibly factor into the cause of death but it would also disprove a significant part of Mosby’s case, namely that the police had no probable cause to arrest Gray.
Either one of these facts would destroy the prosecution’s case, which is why one can assume she doesn’t want the autopsy results to be released. It just goes to show that Mosby and other Baltimore officials are willing to do anything to secure a conviction — even if it means putting innocent men and women, all of them cops, in jail.
